Agreement to Terms
By installing and using BlackBox Attribution (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the App.
These Terms constitute a legal agreement between you (the "Merchant," "you," or "your") and BlackBox Software LLC ("we," "us," or "our").

Service Description
BlackBox Attribution is a Shopify app that provides marketing attribution analytics. The App:
- Tracks visitor interactions on your Shopify store
- Matches orders to marketing channels that drove the sale
- Displays attribution data in a dashboard
- Provides reports and exports of your attribution data
What We Are NOT:
- We are not a marketing agency or advertising platform
- We do not guarantee increased sales or specific results
- We do not provide legal, tax, or financial advice
- We do not replace professional marketing services
Account Registration
Eligibility
To use the App, you must:
- Have a valid Shopify store
- Be at least 18 years old or the age of majority in your jurisdiction
- Have authority to bind your business to these Terms
- Provide accurate and complete registration information
Account Security
You are responsible for:
- Maintaining the security of your Shopify admin access
- All activities that occur under your account
- Notifying us immediately of any unauthorized access at support@getblackbox.io
Subscription Plans and Billing
Available Plans
Free Tier ($0/month):
- 100 orders per month
- 90 days of historical data
- Basic attribution features
Pro Tier:
- Unlimited orders
- Unlimited historical data
- All attribution features
- 7-day free trial
- Early Bird Pricing: $29/month (before June 1, 2026)
- Regular Pricing: $39/month (after June 1, 2026)
- Early Bird subscribers keep $29/month pricing for life
Billing Terms
Payment Processing:
- All charges processed through Shopify's billing system
- Prices displayed in USD (may vary by currency)
- You authorize Shopify to charge your payment method on file
Recurring Charges:
- Subscriptions renew automatically every 30 days
- You'll be charged on the same day each month
- Charges appear on your Shopify invoice
Free Trials:
- Pro tier includes 7-day free trial
- No credit card required for trial
- Trial converts to paid subscription automatically unless cancelled
- Only one free trial per merchant
Cancellation:
- Cancel anytime from the Shopify Apps admin
- No refunds for partial months
- Access continues until end of paid period
- Data retained for 30 days after cancellation
Refund Policy:
- No refunds: All charges are non-refundable
- Cancel anytime: You can cancel your subscription at any time
- Access continues until the end of your paid period
- Data is retained for 30 days after cancellation for easy reactivation

Plan Changes
Upgrades:
- Effective immediately
- Prorated credit applied to first invoice
- Access to new features granted instantly
Downgrades:
- Effective at next billing cycle
- No prorated refunds
- Data exceeding new plan limits may be archived
Price Changes
- We may change pricing with 30 days notice
- Notice sent via email and in-app notification
- Continued use after price change means acceptance
- You may cancel before change takes effect
Acceptable Use
✅ You May:
- Use the App for lawful business purposes
- Access your own store's attribution data
- Export data for your business use
- Integrate with other business tools
❌ You May NOT:
- Resell or redistribute the App
- Reverse engineer or decompile the App
- Use the App for illegal purposes
- Attempt to access other merchants' data
- Overload or interfere with App infrastructure
- Remove or obscure any copyright notices
- Use the App to spam or harass customers
- Violate any applicable laws or regulations
Enforcement
Violation of these Terms may result in:
- Warning and request to cease violation
- Temporary suspension of service
- Permanent termination of account
- Legal action if necessary
Intellectual Property
Our Rights
We retain all rights, title, and interest in:
- The BlackBox Attribution app and all code
- All trademarks, logos, and branding
- All documentation and materials
- All improvements and modifications
Your Rights
You retain all rights to:
- Your store's data and content
- Your customers' information
- Your business operations and marketing
License Grant
We grant you a limited, non-exclusive, non-transferable license to:
- Use the App for your Shopify store
- Access the attribution dashboard
- Export your data
This license terminates when you uninstall the App or violate these Terms.
Data and Privacy
Data Collection
As described in our Privacy Policy, we collect:
- Order data (totals, timestamps, custom attributes)
- Anonymous visitor tracking data
- Store information
We do NOT collect customer names, emails, phone numbers, or addresses.
Your Responsibilities
You represent and warrant that:
- You have authority to share data with us
- You comply with privacy laws (GDPR, CCPA, etc.)
- You have proper consent for tracking visitors
- Your privacy policy discloses app usage
GDPR Compliance
- We act as a Data Processor on your behalf
- You remain the Data Controller
- We implement required GDPR safeguards
- We respond to data deletion requests within 30 days
Data Security
While we implement industry-standard security measures, you acknowledge that:
- No system is 100% secure
- You use the App at your own risk
- We are not liable for security breaches beyond our control
Service Availability
Uptime
We strive for 99.9% uptime, but do not guarantee uninterrupted service.
Scheduled Maintenance
- We may perform maintenance with notice
- Notice provided via email when possible
- Scheduled during low-traffic periods when possible
Service Interruptions
We are not liable for service interruptions due to:
- Shopify platform downtime
- Third-party service failures
- Natural disasters or acts of God
- Internet or telecommunications failures
- Cyberattacks or security incidents
- Scheduled or emergency maintenance
No Warranty
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
1. Direct Damages:
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
2. Indirect Damages:
We are not liable for:
- Lost profits or revenue
- Lost data or business opportunities
- Consequential or incidental damages
- Punitive damages
3. Exclusions:
Some jurisdictions do not allow limitation of implied warranties or liability for incidental damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
4. Time Limit:
Any claims must be brought within 1 year of the event giving rise to the claim.
Indemnification
You agree to indemnify, defend, and hold harmless BlackBox Software LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any laws or regulations
- Your infringement of any third-party rights
- Your customers' claims related to data collection
Termination
By You
You may terminate at any time by:
- Uninstalling the App from Shopify admin
- Contacting support@getblackbox.io to close your account
By Us
We may terminate your access if:
- You violate these Terms
- Your account is inactive for 6+ months
- You provide false or misleading information
- Required by law or regulatory authority
- We discontinue the App (with 30 days notice)
Effect of Termination
Upon termination:
- Your access to the App ends immediately
- All subscriptions are cancelled
- Data is retained for 30 days then permanently deleted
- These Terms survive: IP rights, limitation of liability, indemnification
Changes to Terms
We may modify these Terms at any time by:
- Posting updated Terms on our website
- Updating "Last Updated" date
- Sending email notice for material changes
Your continued use after changes constitutes acceptance.
If you disagree with changes, your sole remedy is to stop using the App.
General Provisions
Governing Law
These Terms are governed by the laws of the State of Nevada, United States, without regard to conflict of law provisions.
Dispute Resolution
Before filing any claim, you agree to attempt to resolve disputes through good faith negotiation by contacting support@getblackbox.io.
Arbitration:
Any disputes not resolved through negotiation shall be resolved through binding arbitration in Clark County, Nevada under the rules of the American Arbitration Association.
Class Action Waiver:
You agree to resolve disputes individually and waive any right to participate in class action lawsuits.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BlackBox Software LLC regarding the App.
Severability
If any provision is found invalid or unenforceable, the remaining provisions remain in full effect.
Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
Assignment
You may not assign these Terms without our written consent. We may assign these Terms to any successor or affiliate.
Force Majeure
We are not liable for delays or failures due to circumstances beyond our reasonable control.

Notices to you may be sent to your email on file with Shopify. Notices to us should be sent to support@getblackbox.io.
